Employer keeps paying salary late, what are my rights?

My SME boss has paid us 1-2 weeks late for three months now, always some excuse. Some colleagues scared to speak up. I want to know what protections we have before deciding to leave or complain.

This is a salary issue and there are real protections. Under the Employment Act, salary must be paid within 7 days after the end of the salary period (overtime within 14). Late or non-payment is a breach. Steps I took at a past job: 1) keep payslips and bank records showing the late dates, 2) raise it in writing to management first (paper trail), 3) if unresolved, approach TADM (Tripartite Alliance for Dispute Management) to file a salary claim, they mediate, and it can escalate to the Employment Claims Tribunals. You don't need to quit to file. Do verify current coverage and limits with MOM/TADM directly, as thresholds and which employees are covered can change. Colleagues can file together, there's strength in documented cases.

TADM mediation worked for two of my friends who were in a similar late-pay situation, it's free to start and you don't need a lawyer. What they noticed is that the boss suddenly became very cooperative the moment MOM's name entered the conversation, because employers know salary claims are taken seriously and they don't want the record. One tip if you eventually resign, be aware there's a time window after leaving employment within which you must file a salary claim, so don't sit on it for months. Gather your payslips and bank records first, then approach TADM. Line up the evidence before the conversation and you'll be in a strong spot.

Document, document, document, this is the single most useful thing you can do right now. Screenshot every late payment date, save every payslip, and keep every message where the boss gives an excuse, because a vague grumble to HR gets ignored but a dated paper trail does not. When I raised it politely in writing with a clear list of the late dates at a previous job, the money suddenly appeared, funny how that works. The reason documentation matters is that if it ever goes to TADM or the tribunal, your records are the case. Start today, back-fill the dates you can from your bank statements, and keep it factual, not angry.

Legally you have solid grounds, but real talk, also quietly line up your next job if the company is this shaky, because consistent late pay for three months often means genuine cash-flow trouble, and cash-flow trouble sometimes ends in the company folding or retrenching, leaving you chasing owed wages. Protect your rights AND your income at the same time, they're not mutually exclusive. File or raise it through the proper channel to protect what you're owed, but also refresh your CV. I've seen colleagues stay loyal to a struggling boss out of guilt and end up unpaid when it collapsed. Confirm the specifics of your protections and claim timelines with MOM.
